As a Canadian, you can purchase real estate in Spain even if you're not a resident. The process is straightforward, but there are important steps and requirements you need to know about.
The NIE is a foreigner identification number required for all property transactions and tax-related activities in Spain.
Work with a real estate agent to find properties that meet your needs. Visit properties in person when possible, and research the neighborhood and local market.
Pay a reservation deposit (around €3,000-€6,000) to take it off the market, followed by signing an arras contract with a 10% deposit.
Important: The arras deposit is binding. If you back out, you typically lose the deposit. If the seller backs out, they must return double.
The final purchase is completed at a notary's office where you sign the escritura (title deed). You'll pay the remaining balance and ownership is transferred.
After signing, you must pay the property transfer tax (ITP) and other associated fees. Your lawyer typically handles these payments.
Register the property in your name at the Land Registry (Registro de la Propiedad). This provides legal protection and proof of ownership.
The ITP is the main tax on resale properties. The rate varies by autonomous region (roughly 6-11%).
